ROBERT POTTER v. WILLIAM NICKS. - Mr. Stogden appeared for plaintiff, and Mr. Fryer for defendant. The plaintiff sought to recover £3 14s. 1d. for cheese, part of which was supplied to defendant's father, who at that time occupied an estate at Matford, part on the occasion of his funeral, and part afterwards to defendant's mother. The defendant was sued as executor. Plaintiff stated that payment had always been promised by old Mr. Nicks, and after his death by his wife; and that on one occasion, defendant himself previous to his mother's death, promised to make up the bill to him. A good deal of property had been left, among the rest a great number of "cows and horses," and this was held by defendant. Defendant, on being sworn, said that during his father's life there was an execution put in by the landlord (Sir L. Palk), that the stock was sold and that his father died insolvent. Some money also which he had advanced on the farm had been entirely lost. His mother had not left him anything; and the stock referred to by plaintiff was bought with money which he had borrowed on security of his wife's property. Mr. Stogden admitted that this was an answer to the case, and at his desire a nonsuit was entered.
